The purchases made by users through our website (“Website”) are governed by the terms and conditions (“Terms”) described below. By purchasing products (“Product”) via gizupp.com, the user fully and unconditionally accepts the following terms and conditions of purchase. These terms do not apply to the sale of our products by third parties outside of the website.

The GIZUPP company may at any time change the conditions or offers (prices, products, promotions and other trade and service conditions) published on its website. However, under no circumstances will the changes affect any purchases made by our users.

Product and manufacturer names and brands are used for identification purposes only. All images, descriptions and prices are not contractually binding.

2. How can I shop on the website?

The order is completed when the user receives an order confirmation email detailing the products purchased and the current terms and conditions. 

3rd Price of the products. Taxes and Customs Duties.

The price includes the indirect taxes resulting from the delivery of the product, as well as the shipping costs. However, GIZUPP is not responsible for the payment of any import taxes or duties that may apply at the time the product is introduced into the country of destination. Additional costs incurred through customs clearance are the responsibility of the recipient of the product. For legal reasons, the recipient of the product is the importer and must therefore comply with all laws and regulations applicable in the country of destination.

4. What are the shipping and transport conditions?

We ship worldwide.

How soon will you receive your order?

As a rule, the delivery time is between 10 and 20 days after receipt of the order confirmation.

If the item is out of stock and cannot be delivered on time, we will inform you of the expected delivery date and you can exchange it for another item or request a refund if you wish.

These dates are non-binding and GIZUPP reserves the right to delay them for reasons not related to the company. In any case, we will always try to shorten delivery times as much as possible in order to guarantee that orders are received quickly and efficiently.

The deadlines set for the delivery of the products are without prejudice to delays that may be caused by force majeure.

What should I do in the event of a delay or error in shipping or delivery? In the event of a delay, delivery error or loss of the product, please contact us as soon as possible. GIZUPP will contact the logistics company to initiate an investigation and clarify the incident as soon as possible. We will do everything in our power for the required time and within 24 to 48 hours we will contact the user and offer a solution or send a new, identical package free of charge.

The user has the right to terminate the contract and pay the amount for the product and delivery if we fail to deliver within the agreed period and under the terms of article 66 bis of Royal Legislative Decree 1/2007 of November 16, 2007 , which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

How much are the shipping costs?

The amount of shipping costs is included in the price of the product.

Where do I get my order? The products are delivered to the address specified by the user on the order form.

5. Payment method

a) Which payment methods can I use?

The products can be paid for by card via the card bank of the payment platform (Visa, Mastercard and American Express) and the PayPal service.

How does the refund work?
The refund of the product amount by GIZUPP will be made using the same payment method that you used at the time of purchase, unless you have specified otherwise; In any case, you will not incur any costs for the reimbursement within a maximum of 30 calendar days from the date on which you informed us of the cancellation.

If the order has been delivered, we may withhold the refund until we have received the products back or until you send us proof that the products have been returned. When you are returning a “Product”, we recommend that you obtain proof of postage.

To return the product, it is necessary that it has not been used and that the original seal or packaging remains intact. Packages in which the user has attached any type of label, adhesive paper or the like will not be accepted. We reserve the right to refuse a full refund if the “product” returned has been damaged.

If the return is made because the user considers the “product” to be defective and wants to refund the amount paid, he also has fourteen working days from the time of receipt of the product to return the product. Refunding in this way does not limit the rights that can help you under the product warranty under the regulations of consumers and users.

The products sold by GIZUPP are subject to the legal guarantee of 2 years from the delivery of new products by the seller, in accordance with the provisions of consumer and user regulations.

11. Force Majeure

A liability of GIZUPP for non-performance or delay in fulfillment of the obligations undertaken shall be excluded if they are due to events that took our reasonable control escape ( “Force Majeure”).

Force majeure includes any act, event, non-performance, omission or accident that is beyond our reasonable control, such as (a) strikes, lockouts or other industrial action; (b) riots, civil unrest, break-ins, terrorist threats or attacks, war (whether declared or not) or threats of war or war preparations; (c) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; (d) Inability to use any means of transport; Inability to use telecommunication systems; and (e) government acts, regulations or restrictions.

The liabilities arising from these Terms will be suspended during the Force Majeure Period and the period will be extended to meet these obligations for a period commensurate with the duration of the Force Majeure Event and we will use all reasonable means to meet the period to end. Force majeure or finding a solution that enables us to meet our obligations despite the force majeure. 

12. Partial legal disability

Should any of these general conditions be declared null and void by a final decision by a competent authority, the remaining conditions will remain in effect and will not be affected by such nullity declaration. 

13. Applicable law and competent courts.

Contracts for the purchase of products through our website and any disputes or claims arising out of or in connection with their purpose or conclusion (including non-contractual disputes or claims) are governed by Spanish law.

All legal disputes arising out of or in connection with the use of the website or such products are subject to the non-exclusive jurisdiction of the Spanish courts and tribunals in the province of Santa Cruz de Tenerife.
